In New Mexico, Shooting Americans Gets You $500


The Intel Hub brings us the following story:
In a clear cut sign of the police state in America, officers in Albuquerque New Mexico are being paid after shooting and sometimes killing American citizens.
That’s right, a sort of bounty system operates in New Mexico which, under a union program, pays officers up to $500 dollars per fatal shooting.
Wow.

Can you imagine the mindset this places in their heads? Think about how money takes over the thought process. "I better shoot suspect-X before Officer-B does, otherwise, I won't get the $500."

NOT the kind of 'Law Enforcers' you want patrolling your neighborhood.

 Meanwhile the family of the victims are probably billed for the bullet(s) used to kill their loved ones. I wouldn't be surprised.

Indiana Governor Signs 'Right To Resist' Law

 Indiana LEO's are alarmed that the Governor has made it lawful for citizens to resist with force unlawful entry into their home or vehicle by police if they think harm is imminent.

Gov. Daniels on Tuesday signed into law Senate Bill 1.
Under the new law, people can resist if they reasonably think police are illegally entering their home or car and force is the only way to protect themselves or someone else from harm.
Nothing new here. There are numerous court decisions supporting a person's right to resist against unlawful arrest:
“Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529. The Court stated: “Where the officer is killed in the course of the disorder which naturally accompanies an attempted arrest that is resisted, the law looks with very different eyes upon the transaction, when the officer had the right to make the arrest, from what it does if the officer had no right. What may be murder in the first case might be nothing more than manslaughter in the other, or the facts might show that no offense had been committed.”
“An arrest made with a defective warrant, or one issued without affidavit, or one that fails to allege a crime is within jurisdiction, and one who is being arrested, may resist arrest and break away. lf the arresting officer is killed by one who is so resisting, the killing will be no more than an involuntary manslaughter.” Housh v. People, 75 111. 491; reaffirmed and quoted in State v. Leach, 7 Conn. 452; State v. Gleason, 32 Kan. 245; Ballard v. State, 43 Ohio 349; State v Rousseau, 241 P. 2d 447; State v. Spaulding, 34 Minn. 3621.
“When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1.
“These principles apply as well to an officer attempting to make an arrest, who abuses his authority and transcends the bounds thereof by the use of unnecessary force and violence, as they do to a private individual who unlawfully uses such force and violence.” Jones v. State, 26 Tex. App. I; Beaverts v. State, 4 Tex. App. 1 75; Skidmore v. State, 43 Tex. 93, 903.
“An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260).
“Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense.” (State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100).
“One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910).
“Story affirmed the right of self-defense by persons held illegally. In his own writings, he had admitted that ‘a situation could arise in which the checks-and-balances principle ceased to work and the various branches of government concurred in a gross usurpation.’ There would be no usual remedy by changing the law or passing an amendment to the Constitution, should the oppressed party be a minority. Story concluded, ‘If there be any remedy at all ... it is a remedy never provided for by human institutions.’ That was the ‘ultimate right of all human beings in extreme cases to resist oppression, and to apply force against ruinous injustice.’” (From Mutiny on the Amistad by Howard Jones, Oxford University Press, 1987, an account of the reading of the decision in the case by Justice Joseph Story of the Supreme Court.
As for grounds for arrest: “The carrying of arms in a quiet, peaceable, and orderly manner, concealed on or about the person, is not a breach of the peace. Nor does such an act of itself, lead to a breach of the peace.” (Wharton’s Criminal and Civil Procedure, 12th Ed., Vol.2: Judy v. Lashley, 5 W. Va. 628, 41 S.E. 197)

S.2213 - Respecting States' Rights and Concealed Carry Reciprocity Act



As promised, Sen. John R. Thune (R-SD) and Sen. David B. Vitter (R-LA) introduced a better Concealed Carry Reciprocity bill than the one by Sen. Mark Begich (D-AK) and Sen. Joe Manchin (D-WV).

This better bill is S.2213 and it will protect residents of both concealed carry as well as Constitutional Carry states unlike the other bill which left the Constitutional Carry States out in the cold.
Thune said that the bill will allow law-abiding concealed carry permit holders to cross state lines without being afraid of breaking the law and that the legislation provides a good balance between respecting the right of states to create their own laws and also protecting gun owners from the different laws of states that they pass through.
Thune said that the law stays in line with the Constitution because it refrains from making a national standard for concealed carry while also protection Second Amendment rights.

The Only Solution…the Simplest Solution…is Secession

Any entity subject to the US Constitution must play by its rules. That includes the US Federal Government and the serf states. But in 2012, Washington completely ignores the Constitution and does exactly what it desires. There are absolutely no control mechanisms on the Federal Government. Ockham’s Razor will indicate that any effort to reform the United States cannot succeed, since remaining a part of the system requires slavish obedience to it. Voting in Federal elections only mollifies the voter and makes him believe his vote matters. Nullification cannot be successful since the States cannot enforce it.

The point of secession is to avoid a Civil War. But we remember how that turned out the first time it was attempted. Doesn't mean we shouldn't try it again, this time with lessons learned.

How Red Tape Kills

And so, the emergency crews stood by waiting until a specialty team arrived, donned protective gear, and waded into the waist-deep water (at maximum depth) to retrieve Mr. Burgess. Needless to say, doctors formally pronounced him dead by the time his body arrived to the hospital, roughly 90-minutes after he fell in the lake.

Execuitive Order "I'm The Dictator" signed

You may or may not heard about Øbama updating an existing Executive Order just a few days ago. It is called the National Defense Resources Preparedness Executive Order.

Some people say it's just a normal administrative procedure. But we've never had a hard-core leftist president like this in office before.

TeaParty.org sums it up:

 The Exec.Order allows the nationalization of pretty much the entire USA even in peacetime if he desires. They can, under this order, restrict civilian travel by any mode, including (probably) foot travel. They can ration food. They can restrict water usage, even from private wells. They can ration any and all drugs, including OTC and vitamins. They can collectivize farms. They can take over all energy production, including home solar units.
It also allows for drafting civilians. If they have need of your skills, they can compel you to work for no compensation.
All this not in a time of war, but in time of “National Emergency” (several EO national emergency states already in place) or even in Peacetime.

Will elections even take place? Even if they do, will it matter with all the blatant voter fraud? Either way, time is running out. Are you prepared yet, or will you be one of those working for free?

Forget S. 2188 - There's a better CCW Reciprocity Bill Coming

My previous post was regarding S. 2188, the National Right to Carry Reciprocity Act of 2012. Forget about it. S. 2188 is sponsored by Senators Mark Begich (D-AK) and Joe Manchin (D-WV). and is a weak compromise bill which still requires a government permit for reciprocity, regardless of state law. In other words, it doesn't recognize CCW from states that do not require a permit; "Constitutional Carry" states. This bill has only one additional co-sponsor.

John Thune (R-SD) and David Vitter (R-LA) will be introducing a bill shortly that will recognizes the right to carry concealed by residents of “Vermont-style” and “Constitutional Carry” states. They have fifteen additional co-sponsors!

These Constitutional Carry states include:
Vermont
Alaska
Wyoming
Arizona
Montana

Other states currently considering Constitutional Carry laws are:
Colorado
Georgia
Iowa
Kentucky
Maine
New Hampshire
Ohio
Oklahoma
Rhode Island
South Carolina
South Dakota (on governor’s desk)

“National Right to Carry Reciprocity Act of 2012” introduced in U.S. Senate

UPDATE: Forget everything you'll read below. Forget S. 2188. This bills pulls the rug out from under those who live in a Constitutional Carry (no permit need) State. This would deny reciprocity for those from Vermont, Alaska, Arizona, Montana and Wyoming. There is a better one.

S. 2188, like H.R. 822, would allow any person with a valid state-issued concealed firearm permit to carry a concealed handgun in any other state that issues concealed firearm permits, or that does not prohibit the carrying of concealed firearms for lawful purposes.

Court Upholds Concealed-Carry Law In Colorado University

Hmm...seems someone in Colorado gets it. Liberals still don't.
"...criminals are criminals because they disobey laws..."
"So, it is impossible to get them in voluntary compliance with gun bans."

The Colorado Supreme Court has ruled. That means rapists, muggers and other criminals should listen up. Students at the University of Colorado are no longer sitting ducks, thanks to legal activism by a group of students from the Colorado Springs campus.
Students are no longer rendered vulnerable by an idiotic gun ban that only threatened the safety of innocent, law-abiding students and university employees. Among thousands of students on any public Colorado campus will be a few who secretly carry weapons and know how to use them, in defense of themselves and others.

That’s not how the University of Colorado Board of Regents wanted it. The board has long imposed a campus gun ban, even on any student who has been granted a concealed-carry permit by a Colorado sheriff. This ban, of course, tells rapists, muggers, abusive boyfriends or girlfriends, psychotics and all varieties of potential evildoers that CU has eliminated the possibility of anyone shooting back. The law is supposed to apply to innocent students, faculty and criminals. Problem is, criminals are criminals because they disobey laws. The creepiest of criminals gladly ignore serious laws — the kind that impose big penalties for assault and murder. So, it is impossible to get them in voluntary compliance with gun bans. “Gee,” says the criminal. “I was going to shoot up the place and commit murder. Then I read that my gun isn’t allowed on the location of my anticipated crime. To obey this rule, I will have to forgo rape and murder today.”

It’s a ridiculous expectation that obviously gives criminals an advantage over victims. We have seen it play out too many times. At Virginia Tech, for example, a psychotic had his run of the campus for hours because all of his potential victims were obeying a campus gun ban. Bad policy enabled mass murder.

Law-abiding Colorado residents are entitled to concealed carry permits by the Colorado Concealed Carry Act. Passed by the Legislature in 2003, the law says a person with a permit may carry a concealed weapon “in all areas of the state.” Noted exemptions include some federal properties, K-12 schools and buildings with fixed-security checkpoints.

It is not the people who wish for their lives to come to an end. It is not the wish of the people to see their comfort disturbed, to be forced out into the streets to try desperately to save those things of value to a great nation. There would be nothing better in life than to recline with a laptop and browse the Internet with nothing on one's mind but leisure and entertainment. For those without conscience, this is still possible...for now. But no level of disengagement will survive the insatiable demand of government for control.

One might think themselves safe with their porn and progressive lifestyle. Wait. They will come for you, when they are finished with us.

Liberty is the item on the agenda, it is the one thing the government cannot abide. Liberty is the limitation of power, it is the forestalling of their dream of control.

Those in government today do not have the will of their convictions, they do not have the ability to stand before the withering gaze of others and do what is right. They do not stand for the Constitution they have sworn to defend. They are incapable of principle. If so, where are they?

Give us allies among the police, the military, we will take them, we will work with them to secure our rights, everyone's rights. Liberty is not worth dying for if it is mine alone that I seek. It is insane to die for one's own liberty, which must be forfeit at the dying. Don't you see? Liberty is only worth dying for if it benefits others. Does an officer of the law venture out into the night with a sidearm to confront criminals in order to stay safe? Why not stay in the squad car? Do you expect us to act any differently when we see corruption and criminals everywhere in government?

Who will do it? Who will protect the people from government? Is it the ten-year veteran police officer owing allegiance to the government department, his/her union, his/her family? Will they be the ones to step out of line and acknowledge the un-Constitutional nature of their duties? We have been waiting.

Where do these liberty groups come from? What purpose does the Tea Party serve? One cannot exist in America today and not see the angst of the people in all these different manifestations. What do they ask? Do these groups ask for power or prestige? Do they seek rights from others? No, they ask only for their rights to be acknowledged and respected and for government to cease violations of those rights so clearly identified in the Bill of Rights. No, it is not muddied and unclear, these rights are not vague and in need of clarification by the government, they are plain and in simple language so that all can see their purpose.

Phrases such as "Congress shall make no law" are not difficult to understand, yet it has made such laws and has been supported by the government justices. No surprise. The few things government is supposed to do, it refuses to do. It does not declare war anymore; it does not defend the borders anymore; it does not protect the votes of citizens anymore. It does sell guns to Mexican cartels who then turn around and violate the borders of the nation and kill American citizens. All for a political gamble to further restrict the Second Amendment.

Government cannot tolerate the rights of the people, because it limits their ability to exert control. Nothing else. Look no further than that. Rights of search and seizure are there for a reason, to keep the government out of the people's lives, out of their papers, out of their private matters, yet it is violated at the drop of a hat in order to exert control. There are ways to obtain evidence of a crime without making criminals of everyone to allow random inspection. Upon oath and describing the particular things to be searched for and seized. That's not a tough hill to climb where crimes have been committed and a suspect is identified.

On down the line it goes, from Religious freedom, freedom of the press, the right to possess a weapon, the right to be free from random searches and seizures, the right to confront one's witnesses against them, all of these things are under assault because it makes it easier for the government to exert control.

We in the liberty movement have seen the progression over the span of our lives. We have watched as every crisis takes from us another liberty, violates another right. The government continues to create enemies from which the people need to be safe, like Anti-Government Extremists. We are not extreme, we are righteously against a corrupt and criminal government that has refused its limitations. We can read the Bill of Rights and know when it is government itself that is in violation of the law.

Had we seen a stopping point, a barrier that the government will not cross our purpose would cease. We might then become advocates of certain violations, but we would be able to legally walk back these excesses within a justice system that could acknowledge excess. Were the Supreme Court to act as defenders of the Constitution rather than creators of a "civil society" we could place our fates in their hands.

Nothing would be better than to know that we were safe from the abuses of government via some benefactor who would have the power to take up our case and let justice prevail. But, it is the power of government itself that precludes this possibility. It has corrupted all avenues of justice within its structure.

So, we have been led to this place, this desperation by the actions of the government seeking power over us. The government that seeks to be free of the bondage placed on it by the Constitution. It does so with the complicity of those sworn to defend the Constitution, who are also paid by the government and supported in retirement by the government. Who are we to appeal to?

Even a house cat is dangerous when left no avenue of escape and fears for its life. The government has gotten its wish, it has bound us up, left us nowhere to seek redress, no one to appeal to for help...except each other. It is with no pleasure that we take the next step.

Militia's On The Rise - Quick Run! Hide!

 Looks like Mark Potok over at the Southern Poverty Law Center, (SPLC) is at it again with his disingenuous scare mongering.

Oh my! The Militia Boogie-Man is a rising threat! (again)

The radical right grew explosively in 2011, the third such dramatic expansion in as many years. The growth was fueled by superheated fears generated by economic dislocation, a proliferation of demonizing conspiracy theories, the changing racial makeup of America, and the prospect of four more years under a black president who many on the far right view as an enemy to their country.

Yawn.

Same old thing from Potok.

He incorrectly and purposefully groups Neo-Nazi's and racist groups with Constitutional Militias and the Tea Party in an effort to discredit them and create a non-existent fear within the general population.

He has the full backing of the Lame-Stream-Media as well, who are all too eager to lap up his pile of vomit and sensationalize it to homes across the country.


NPR
is reporting it. MSNBC is reporting it. Other cogs of the propaganda machine will start reporting it soon enough.

The FBI (Fumbling Bumbling Incompetents) and other Law Enforcement Agencies use the SPLC statistics as an official source as well. What does that tell you?

Meanwhile he conveniently ignores the Muslim threat. Gee, why is that?

How many militia members shot unarmed soldiers in Fort Hood? Oh, wait. That was a Muslim workplace violence incident. Never mind.

How many militia members walked down a street in L.A. randomly shooting at cars? Huh? It was a man yelling "Allahu Akbar" you say? Never mind.

Don't forget those militia members who shot and killed 1 soldier and wounded another at an Arkansas Army recruitment center. Oh, it was a Muslim convert? For sure I thought it was those militia guys. Never mind.

Well how about those racist hate filled militia members who shot and killed 6 Jews in Seattle? Again?! A Muslim?!

I think you see where I am going with this. Is it any wonder the SPLC is referred to as the Socialist Propaganda Lie Center?

If they were honest, they'd understand that the Constitutional Militia is not something to be feared, but a duty to be a part of as required in the 2nd Amendment.

 The final tally for Operation #EFAD: there were 33,533 free downloads of Enemies Foreign And Domestic from March 1 to 5.

The highest ranking it received was #2 for all Kindle genre fiction, for ten hours on Day 2, Friday March 2. 


 EFAD was trapped underneath the Desperate, Delicious Divorcee all day Friday. I just could not climb on top of her, not even for one hour. Perhaps it's a sign of the times, or a reflection of the culture wars, that a major novel about defending freedom could not rise above a serial novella featuring a DDD-bust-sized amateur sleuth from the Kindle $0.99 cent "bargain books" list, not even when both were offered for free. Or maybe people just like to click on a picture of a nice set of boobs.

 I'm more proud to have been next to Vince Flynn at number four on the mystery/thrillers rankings. I was #1 for a while, but I missed my chance to get a screen capture, because I was only refreshing the "all genre fiction" page while trapped below the Delicious DDD Divorcee. I didn't even think to check the mystery/thriller rankings until I was sliding back down the "all genre fiction" list. But it's also very nice to have been side-by-side with Vince Flynn for a while. Too bad I missed the #1 mystery/thriller screen cap, though. Darn it!

And to my knowledge, no telephone ninjas were successful at getting through to a national talk radio host. My sincere gratitude to anyone who made the attempt. I did receive some invitations to appear on a few major-market radio programs, and I promise I will use the opportunity to discuss creeping tyranny, and federal abuses such as Operation Fast And Furious.

And even though the big national talk radio breakthrough didn't happen during the free download period, it would still be extremely beneficial to the cause to have Enemies Foreign And Domestic mentioned at any time. The Second Amendment provides WE THE PEOPLE with the arms necessary to defend hearth and home, life and property, and our FREEDOM against a tyrannical government, like we are seeing today, that bypass the Constitution, show no respect for out traditions, hold Congress in contempt, and refuse to follow the Rule of Law.
